Consumer Terms of Service

1. Agreement to Terms
By accessing or using the MarketLink platform (“Platform”), you (“Consumer” or “you”) agree to be bound by these Consumer Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and Wipro Healthplan Services (“MarketLink,” “we,” “us,” or “our”). If you do not agree to these Terms, do not use the Platform.
MarketLink is being prepared as a CMS Enhanced Direct Enrollment (EDE) web-broker portal under 45 CFR § 155.220. Marketplace eligibility determinations and Qualified Health Plan (QHP) enrollment transactions depend on final CMS approval, configuration, and connected production services.
2. Eligibility and Account Registration
To use the Platform, you must:
- Be a U.S. resident and at least 18 years of age, or an emancipated minor;
- Be seeking health insurance coverage for yourself and/or your household members;
- Provide accurate, complete, and current information during registration and enrollment;
- Maintain the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account. Notify us immediately at support@marketlink.ai if you suspect unauthorized access.
3. Broker Assistance and Your Rights
When you work with a licensed broker through the Platform, you have the right to:
- Choose any licensed broker to assist you, or to work without a broker;
- Revoke your Appointment of Representative (AOR) at any time by contacting us or your broker;
- Receive enrollment assistance at no additional cost to you — brokers are compensated by insurance carriers, not by you;
- Receive accurate and unbiased information about all available plans, not just those with higher commissions;
- File a complaint if you believe a broker has acted improperly (see Section 9).
No broker may charge you a fee, surcharge, or any other compensation for enrollment assistance. If a broker requests payment, refuse and report it immediately to compliance@marketlink.ai.
4. Privacy and Data Use
Your use of the Platform is governed by our Privacy Notice, which is incorporated into these Terms by reference. We collect and use your personal and health information solely to determine your eligibility for and facilitate your enrollment in health coverage. We do not sell your personal information.
By using the Platform, you consent to the collection, processing, and transmission of your personally identifiable information (PII) and protected health information (PHI) to the Centers for Medicare and Medicaid Services (CMS), insurance carriers, and other parties as required to process your enrollment, consistent with our Privacy Notice and 45 CFR § 155.260.
5. Accuracy of Information
You represent and warrant that all information you provide during the enrollment process is true, accurate, complete, and not misleading. This includes information about:
- Household size and composition;
- Household income for Advanced Premium Tax Credit (APTC) and Cost-Sharing Reduction (CSR) eligibility;
- Special Enrollment Period (SEP) qualifying events;
- Other insurance coverage.
Providing false or misleading information may constitute fraud under federal and state law (42 U.S.C. § 18001 et seq.), may result in termination of coverage, repayment of APTCs, civil penalties, and/or criminal prosecution.
6. Special Enrollment Periods
If you are enrolling outside of the Open Enrollment Period, you must have a qualifying life event (SEP). By enrolling, you attest that you have a qualifying event. MarketLink and your broker may request documentation to verify your SEP eligibility. Failure to provide documentation may result in your enrollment being canceled by CMS or the carrier.
7. Advanced Premium Tax Credits
If you are eligible for APTCs, the amount is estimated based on the income information you provide. You must reconcile your APTCs on your federal tax return each year. If your actual income differs from your estimate, you may owe additional taxes or receive a refund. MarketLink is not responsible for tax consequences arising from changes in your income or household. Consult a tax professional for advice.
8. Prohibited Conduct
You agree not to:
- Provide false information to obtain coverage or APTCs you are not entitled to;
- Attempt to enroll in coverage you are ineligible for;
- Interfere with or disrupt the Platform or its security features;
- Attempt to gain unauthorized access to other users' accounts or data;
- Use the Platform for any unlawful purpose.
9. Complaints and Dispute Resolution
If you have a complaint about the Platform, a broker, or your enrollment experience, contact us at complaints@marketlink.ai. We will acknowledge your complaint within 2 business days and respond within 10 business days.
You may also file a complaint directly with:
- CMS Marketplace Help Center: 1-800-318-2596 or HealthCare.gov;
- Your state insurance department;
- HHS Office for Civil Rights for discrimination complaints: ocrportal.hhs.gov.
10. Disclaimers and Limitation of Liability
The Platform is provided “as is.” MarketLink does not guarantee the availability of any specific health plan, APTC amount, or enrollment outcome. We are not an insurance company and do not underwrite health coverage. Your coverage is governed by the terms of your health plan with the applicable insurance carrier.
To the fullest extent permitted by law, MarketLink's liability to you for any claim arising from your use of the Platform shall not exceed $500. MarketLink is not liable for indirect, incidental, special, consequential, or punitive damages.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Platform at least 30 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
